Instructions for submitting a claim abroad

Are you an author and unsure whether you are entitled to royalties for a work broadcast abroad? If so, you need to consider the following three points:

  1. Registration: you need to submit your work to us and complete the international fiche so that we can register it in the CISNET international database.
  2. Timeframe: no retrospective claims can be made. Your work is eligible for royalty payments upon registration with ZAiKS.
  3. Claim period: up to 3 years from the first date of your work being used.

How do I submit a claim?

Having received your application, we will check that the information submitted is sufficient for our relevant partner society to pursue a case.

  • Download the relevant form from our website (available categories: concert, radio & tv, mechanical media, in-film music, Internet, advertising).
  • Fill in the form - the more detailed the data, the greater the likelihood that our partner society will detect the use of such a work and collect the royalties due.
  • Send the form to international@zaiks.org.pl. We will keep youupdated on the progress of your case, whether in Poland or abroad.

Required information (complete form)

  • For use in a live concert - songs performed, performance date and venue and promoter details (address, telephone number).
  • For use in radio and TV broadcasts - song titles, channel, time of broadcast (the channel must be licensed by the society concerned).
  • For use on mechanical media - title of the carrier/disc, producer,and year of release.
  • For use in films - film title, year of production and screening dates.
  • For Internet use - link to the material.
  • For use in advertising* - title of advertisement, name of product, authors/performers, date(s) of broadcast, duration.

How to register a concert abroad:

  1. To register your concert in another country please send information to international@zaiks.org.pl.
  2. When submitting information about a concert performed outside of Poland, it is very important in to provide as much detail as possible on the date and venue, the authors of the lyrics and music, in addition to sending a full playlist.

How to make a claim for a concert performed in another country (up to approximately 1.5 years after the performance):

  1. Download and complete the international claim form with the applicable playlist.
  2. Email the form to international@zaiks.org.pl.

*In the case of advertising, different countries have different requirements and legislation regarding the collection of royalties for music in advertising varies significantly. For example, not every territory honours the authors of music in advertising and not every country requires the same information to pursue a case.
